There has been a lot of talk about irregularities in the courts. What would happen if a person illegally registered a land worth billions near the residence of the Chief Justice leading the court and registered it illegally? The fact that the middleman played a role in the transfer of the high court judge on September 15, 2008 has been revealed by himself. Similarly, Bharat Chaulagai, one of the middlemen, has brought Binod Sharma to the Patan High Court to settle a big case and he has been given the responsibility of the judge of the revenue tribunal by the Council of Ministers. Bharat Chaulagai is known as a middleman of the court that has emerged in recent times. He is rumored to be taking the name of Chief Justice Cholendra Shamsher Rana and setting the stage to win any case in the court. According to a source, he has already settled the case of excise duty fraud of around Rs 330 million after bringing the judge he wants in the high court.
The Inland Revenue Office, Birgunj, Parsa, had found that Jayshree Dhawalagiri Distillery and Udaipur Distillery in Pokhariya Municipality of Parsa had swindled around Rs 320 million by misusing excise stickers. Jayashree Dhawalagiri Distillery has evaded excise duty of Rs. 547,059,773, according to the Inland Revenue Office, Birgunj. The Inland Revenue Office had found that the Udaipur Distillery had cheated the excise duty of Rs. 261.57 million on September 25. Gopi Krishna Koirala, the then chief of the Inland Revenue Office, Birgunj, had ruled that the two distilleries had evaded excise duty of Rs 316.33 million. He is also the chief excise officer of the Inland Revenue Office.
Jayashree Dhawalagiri and Udaipur Distillery had appealed against the decision of the excise officer to the Revenue Tribunal in Pulchowk on November 7, 2008. Jayashree is the director of Dhawalagiri Distillery and Udaipur Distillery. Jayashree is Shambhusharan Prasad Kalwar of Dhawalagiri and Om Prakash Kalwar of Udaipur Distillery. The excise officer had decided to collect Rs. If the amount is not paid, it is decided to collect the property as per Section 164 (2) of the Criminal Code, 2074 BS. If the property is not recovered, the person will be sentenced to 7 years imprisonment as per sub-section 7 of section 164 of the same act.
Deputy Subba Hem Kumar Chaudhary, who was appointed as the excise inspector, had given the amount of excise sticker and the amount shown in the sticker income and expenditure account during the emergency inspection in both the distilleries on April 10, 2008. It is mentioned in the decision made by the excise officer that the excise sticker taken from the tax office was not only tampered with, but a double and triple bill was issued. The distillery operators Shambhusharan and Omprakash Kalwar had decided to take action against the excise revenue evaders by concealing and misusing the excise sticker for the purpose of suppressing excise revenue.
Haribansh Kalwar and Pappukumar Gupta, sons of Shambhu Prasad Kalwar, have already settled with Bharat Chaulagai to win the case filed in the revenue tribunal by these two distilleries which are killing Rs 320 million in revenue to the government. Chaulagai has already made a deal of Rs 130 million and deposited Rs 30 million in the name of a person of Joshi Thar. Chaulagai said that he had direct access to the Chief Justice and that he had transferred Binod Sharma to the Revenue Tribunal by himself and had sent him away asking him to bring other issues as well.
Excise officials have taken the responsibility of issuing orders without paying a single rupee even though the revenue of Rs 320 million has been swindled. According to a source, Haribansh Kalwar has said that the case will be decided after Tihar. According to sources, Pappukumar Gupta, who got Nepali citizenship from Parsa even though he is an Indian citizen dealing with Chaulagai, is staying at Bagmati Hotel in Gaushala. He has deposited the first installment of the bribe in the account. When Haribansh Kalwar was asked about setting up a court and mediating to win the case, he said, “If there is evidence of setting up, show it.” Asked if there is any evidence of bribery, he said, “How can there be any allegation of setting without proof?”
Chief Tax Officer of the Inland Revenue Office, Parsa, Sunil Yadav said that the factory was sealed as it could destroy fake excise duty liquor stickers and invoices. We did not allow the factory to be opened as it was not clear about the bail given by the tribunal in the letter dated 4 September 2077. But we have been forced to reopen the factory after the revenue tribunal ordered that the factory be allowed to operate even without bail. ‘
